Automobile accidents/wrecks and injuries
An automobile accident is often a frightening and painful experience. And the aftermath of a wreck – the resolution of an auto claim – can be traumatic in its own right. This is true whether an injured party was a driver, a passenger or a pedestrian hurt by an automobile.
From a legal and insurance standpoint, there are essentially two (2) elements associated with every car wreck – property damage and bodily injury. It is possible after a wreck, that neither property damage nor bodily injury is existent. It is more likely, however, that at least one (1) if not both of the two (2) referenced elements is present. If that is the case, navigating the insurance and legal minefield that awaits you in Georgia can be perilous.
In property damage matters, a claimant must consider, among other things, compensation and arrangements for repairs, rental transportation, towing fees, storage fees, total loss adjustment, diminution of fair market value, etc. For people who do not regularly deal with these issues, trying to resolve such matters without legal counsel can result in the accidental, but permanent, compromise of important legal rights with very expensive consequences. The same holds true for the handling of bodily injury/wrongful death claims arising out of a motor vehicle wreck.
A personal injury or wrongful death which is related to a wreck necessarily creates legal questions regarding the various drivers’ liability, legal causation and damages. The inquiry does not stop here, though. There are issues that the average person does not typically know about with regard to liability insurance, uninsured/underinsured motorist insurance, healthcare subrogation and the like. A lay person’s failure to appreciate the procedures that are necessary to asserting a successful damages claim associated with a motor vehicle accident can be devastating.
Securing prompt expert accident reconstruction services, gathering and preserving data and physical evidence from the wreck scene, identifying eyewitnesses (many of whom are often left off the accident report by well-meaning law enforcement officers), providing timely contractual notice to insurance carriers, providing timely ante litem notice to government entities, facilitating healthcare for legitimate wreck-related injuries and so forth are tasks that may not be easily tackled by a car-wreck novice. Likewise, identifying all the prospective contributing factors to an accident (such as the road itself, construction or work crews in the vicinity of the road, improper vehicle maintenance/repairs, defective vehicle/component designs or manufacturing, alcohol service by a tavern or bar, etc.) may be areas of investigation that can be overlooked by an untrained eye.
The Dow Firm, P.C. regularly assists people with property damage and personal injury claims against negligent drivers and insurance companies that delight in “adjusting” claims against injured beginners. We want to be the arbiter that makes sure you truly get treated fairly by the opposing driver’s liability carrier. Whether it is our firm or another firm, we strongly encourage you not to go it alone under the usually-false assumption that you can save money by foregoing legal counsel. After all, if the driver that hit you is in good hands, shouldn’t you be as well?
