Legal malpractice

Lawyers exist to help clients with legal issues, not compound their problems.   If a legal case is lost or compromised due to the negligence of an attorney and/or the attorney’s law firm staff, a client may have an avenue for recovery for the losses.

The process for prosecuting a legal malpractice case in Georgia is somewhat complicated as it is deemed a “professional negligence” matter requiring special pleadings (under O.C.G.A. § 9-11-9.1) to initiate suit.  Substantively, in order to recover for legal malpractice under Georgia law, a client must demonstrate that his/her counsel committed a significant error that irreparably damaged the client’s case and that, but for the error, the client would have prevailed in the underlying action.
