Professional negligence
In Georgia, certain professionals who have particular training and skills (which are not naturally possessed by the average person) provide specialized services to the public. In providing these services, professionals must adhere to the standard of care applicable to their industry. While professionals do possess special training and skill, this fact does not guarantee they are incapable of making mistakes. In fact, professionals do make mistakes and, because of the technical nature of the undertaking in which they are providing services, often these errors result in serious consequences causing large losses to their clients.
When a client is harmed by a professional in the state of Georgia, the law imposes specific requirements upon a victim which must be satisfied in order for a victim to validly file a lawsuit against the professional. This includes the filing of an expert affidavit with a plaintiff’s complaint (where the expert affidavit is factually critical of the negligent professional services rendered to the plaintiff). See, O.C.G.A. § 9-11-9.1. In addition to citing the professional negligence, under O.C.G.A. § 24-9-67.1 the affidavit must be executed by an expert who is qualified to render a critical opinion against his fellow professional.
